In addition to traditional common law claims, the Virginia Consumer Protection Act prohibits businesses and/or certain individuals from using any deception, fraud, false pretenses, false promises, or misrepresentations in connection with a consumer transaction or charging upfront fees for foreclosure prevention services. Some of the most common violations of the Virginia Consumer Protection Act occur when a business or seller:

  • Misrepresent that goods or services are of a particular quality, grade, style or model;
  • Paying upfront fees for foreclosure rescue services;
  • Misrepresent that repairs, alterations or modifications have been performed;
  • Fail to disclose conditions or charges relating to the return of goods for a refund or exchange;
  • Misrepresent the geographic origin of goods or services;
  • Sell goods that are used, secondhand, repossessed, or blemished without clearly indicating in the offer for sale that the goods are used, secondhand, repossessed, or blemished.
